Terms and Conditions

These Terms and Conditions govern your access to smdigital.pk and your use of SM Digital services. By using the website, submitting a form, enrolling, purchasing, attending an event or accepting a proposal, you agree to these terms and any written service-specific terms provided to you. If you do not agree, do not use the relevant service.

SM Digital provides career branding and evaluation, professional training, internships and talent programmes, events, certificates, websites, branding, marketing and related digital services. Features, schedules, instructors, delivery methods and availability may change when reasonably necessary.

Website descriptions are general information. A quotation, enrollment confirmation, order form, statement of work or other written agreement may contain additional terms. If there is a conflict, the service-specific written agreement applies to that service.

You must provide current, complete and accurate information. If you are under 18, a parent or legal guardian should approve your use of a paid service and may be required to provide consent. You are responsible for keeping any access credentials confidential and for activity carried out through your account or registration.

You must not:

• use the website or our training for unlawful, deceptive, abusive or harmful activity;
• attempt to bypass security, disrupt systems, introduce malicious code, scrape protected data or gain unauthorised access;
• impersonate another person, submit false records or misuse certificates, visitor passes or verification tools;
• copy, resell, publish or distribute course materials or paid deliverables without written permission; or
• use cybersecurity, AI or technical instruction to attack systems, violate privacy or infringe third-party rights.

Enrollment is confirmed only after any stated eligibility, documentation and payment requirements are met. Course dates, trainers, venues and delivery formats may change because of attendance, operational or safety needs. We will make reasonable efforts to notify enrolled participants of material changes.

Learners are responsible for attendance, assignments, conduct, equipment and prerequisites stated for a course. Access to materials is personal and may be time-limited. Completion alone does not guarantee a particular skill level, job, income, admission or professional licence.

A certificate may be issued only when the stated attendance, assessment, conduct, payment or completion criteria are met. Certificate records may include a unique identifier and verification page. A certificate confirms the programme or experience stated on it; it is not a degree, government licence or external accreditation unless the certificate expressly says so. Altered, duplicated or fraudulently used certificates may be revoked.

CV evaluations, writing, profile development, interview preparation and related services are based on information you provide and professional judgment at the time of delivery. You remain responsible for reviewing accuracy and approving final documents before using them. We do not guarantee interviews, employment, visas, promotions, salary levels or employer decisions.

Project scope, milestones, revision limits, client responsibilities, fees and delivery dates will be defined in writing where applicable. You must supply lawful content, timely feedback, permissions and access needed for delivery. Delays in approvals or materials may move the schedule. Work outside the agreed scope may require a revised quotation.

Prices and payment schedules are those displayed or confirmed to you when you order. You are responsible for any applicable transfer charges or taxes. Access, enrollment or delivery may be paused while an amount is overdue.

Cancellation, transfer and refund rules may differ by course or service and will be stated at purchase or in the relevant proposal. Unless a written policy says otherwise, amounts for completed work, reserved course seats, delivered materials and customised work already started are not refundable. Nothing in this section limits a right that cannot lawfully be excluded.

The website, SM Digital brand, course materials, templates, graphics, software and original content are owned by or licensed to SM Digital and are protected by applicable intellectual property laws. We grant you a limited, personal, non-transferable right to use materials supplied for your own learning or the agreed business purpose.

You retain ownership of materials you supply. You confirm that you have permission to use them and grant us the limited right to process, adapt and display them as needed to perform the agreed service. Ownership and usage rights for custom deliverables are governed by the applicable written proposal.

Some services depend on hosting, social media, messaging, analytics, payment, software or other third-party platforms. Their availability and terms are outside our control. Links are provided for convenience and do not mean we endorse every statement, product or practice on an external website.

Each party should protect confidential project information received from the other and use it only for the agreed purpose. This does not apply to information already public, independently developed or lawfully obtained elsewhere. Personal information is handled as described in our Privacy Policy.

We aim to keep the website and services accurate and available, but interruptions, errors and delays can occur. Services are provided with reasonable care and skill, subject to any specific written commitments.

To the maximum extent permitted by applicable law, SM Digital is not responsible for indirect, incidental or consequential loss, lost opportunities, lost profits or third-party decisions arising from use of the website or services. Where liability cannot be excluded, our total liability for a paid service will not exceed the amount paid to SM Digital for the specific service giving rise to the claim. Mandatory legal rights remain unaffected.

We may suspend or end access where payment is overdue, conduct is unsafe or disruptive, information is fraudulent, intellectual property is misused, systems are threatened or these terms are materially breached. You may stop using the website at any time. Clauses that are intended to continue, including payment, confidentiality, intellectual property and liability provisions, survive termination.

These terms are governed by the applicable laws of Pakistan. The parties should first try to resolve a dispute in good faith by contacting each other. If it cannot be resolved, it may be brought before a court of competent jurisdiction in Rawalpindi, Pakistan, unless mandatory law requires another forum.

We may update these terms to reflect service, operational or legal changes. The updated version applies from the date shown on this page. If a provision is found unenforceable, the remaining provisions continue in effect.
